DMCA POLICY

1. Overview

Through The Glass Creatives Global – FZCO ("TTGC", "we", "us") respects the intellectual property rights of others and expects our users and clients to do the same.

This Policy describes how we respond to notices of alleged copyright infringement under the United States Digital Millennium Copyright Act (DMCA) (17 U.S.C. §512) and how copyright owners or their agents may submit takedown notices to us. Parallel protection is available under UAE Federal Law No. 38 of 2021 on Copyrights and Neighboring Rights and other applicable copyright laws. This Policy is intended to satisfy the procedural expectations of those regimes to the extent they apply to content hosted by or accessible through our Site.

This Policy is not legal advice. If you are unsure whether a use of a work is infringing, consult a qualified attorney before submitting a notice.

2. Before You Submit a Notice

Please consider the following before filing a takedown notice:

  • Own the copyright. You must be the copyright owner or an authorized agent of the owner.
  • Investigate. Make sure the use is actually unauthorized. Fair use, fair dealing, licenses, and other exceptions may apply.
  • Try contacting the content owner first. Many disputes are resolved faster by reaching out directly.
  • No automated bots. Do not use automated bulk submission systems. Each notice must be reviewed and attested by a person.
  • Swear to the facts. The DMCA requires your notice to include a statement made under penalty of perjury. Knowingly submitting a false notice is a federal crime under 18 U.S.C. §1621 and a basis for civil liability. Knowingly false statements may also be actionable under UAE law.

3. How to Submit a Takedown Notice

Send your notice by email or post to our designated agent. Email is preferred for faster processing.

Required information

Your notice must include all of the following. Incomplete notices will not be processed.

  1. Signature. A physical or electronic signature of the copyright owner or an authorized agent. Typing your full legal name is acceptable as an electronic signature.
  2. Identification of the work. A description of the copyrighted work you claim has been infringed. If multiple works are covered, a representative list is acceptable.
  3. Identification of the allegedly infringing material. The URL(s) or other location(s) on our Site where the material appears, with enough detail for us to find it.
  4. Your contact information. Full name, mailing address, telephone number, and email address.
  5. Good-faith statement. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  6. Accuracy and authority statement, made under penalty of perjury. A statement that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Please send plain-text notices in the body of your email, not as attachments where possible.

4. What We Do With Your Notice

When we receive a properly completed notice, we will:

  • review the notice to confirm it meets the DMCA's minimum requirements;
  • if valid, disable or remove access to the identified material;
  • notify the user, client, or account holder who posted, uploaded, or is otherwise responsible for the material, and provide them with a copy of the notice (including your contact information) so they can submit a counter-notice if they wish;
  • take no position on the merits of the claim — we only verify procedural compliance.

We do not act as an arbiter of copyright disputes. The merits are for the parties, their attorneys, and (if necessary) a court to determine.

5. Counter-Notices

If you are a user, client, or account holder whose content has been removed or disabled in response to a takedown notice, and you believe in good faith that the content was removed or disabled as a result of mistake or misidentification, you may submit a counter-notice.

Where to send counter-notices

Use the same contact details as §3. Subject line: DMCA Counter-Notice

Required information for counter-notices

  1. Signature. Your physical or electronic signature.

  2. Identification of the material. A description of the material that was removed or disabled, and the location where it appeared before removal.

  3. Good-faith statement. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.

  4. Consent to jurisdiction. A statement that:

    • (if your address is in the United States) you consent to the jurisdiction of the federal district court for the judicial district in which your address is located;
    • (if your address is outside the United States) you consent to the jurisdiction of any judicial district in which TTGC may be found, including the courts of the United Arab Emirates (where TTGC is based);

    and that you will accept service of process from the person who provided the original takedown notice or their agent. This language is intended to track the requirements of 17 U.S.C. §512(g)(3)(D).

  5. Your contact information. Full name, mailing address, telephone number, and email address.

What happens after a counter-notice

We will forward a copy of your counter-notice to the original complainant. Unless the original complainant notifies us that they have filed a court action seeking to restrain the allegedly infringing activity, we will restore access to the material no sooner than ten (10) and no later than fourteen (14) business days after receipt of the counter-notice.

6. Repeat Infringer Policy

Consistent with 17 U.S.C. §512(i), we have adopted and implement a policy of terminating, in appropriate circumstances, the accounts, access, or service of users, clients, and subscribers who are repeat infringers.

A "repeat infringer" for purposes of this Policy is any person or entity who has been the subject of two or more valid takedown notices accepted by us, or one or more findings of infringement by a court of competent jurisdiction, in any rolling twelve-month period. We reserve the right to suspend or terminate service and account access immediately for repeat infringement, without refund and without prejudice to our other remedies.

7. Misuse

Knowingly submitting a materially false takedown notice or counter-notice can result in liability for damages, including costs and attorneys' fees, under 17 U.S.C. §512(f) and corresponding provisions of applicable law. We reserve the right to pursue such remedies and to cooperate with authorities investigating fraudulent submissions.

8. Changes to this Policy

We may update this Policy from time to time. The effective date at the top of this page reflects the current version. Prior versions are archived at ttgcreatives.com/legal/dmca/archive/.
