1. About these Terms

These Website Terms of Service (the “Terms”) govern your access to and use of the website operated by Through The Glass Creatives Global – FZCO (“TTGC”, “we”, “us”) at ttgcreatives.com and any subdomains (the “Site”).

By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

These Terms govern only your use of the Site itself. They do not govern paid creative services. Paid services are governed by our Master Services Agreement (ttgcreatives.com/msa) for project and retainer clients, and our Subscription Terms (ttgcreatives.com/terms) for subscription plans. In the event of any conflict between these Terms and the MSA or Subscription Terms, the MSA or Subscription Terms (as applicable) govern the paid-services relationship.

3. Eligibility

You may use the Site only if you are at least 18 years old and legally able to enter into a binding agreement under the laws of your jurisdiction. If you access the Site on behalf of a company or other legal entity, you represent that you are authorized to bind that entity to these Terms, and “you” refers to both you individually and that entity.

4. Account Registration

Some areas of the Site may require an account. When you register:

• provide accurate, complete, and current information;
• keep your password confidential;
• notify us immediately of any unauthorized access or security concern at support@ttgcreatives.com.

You are responsible for all activity under your account. We may suspend or terminate your account at our discretion for violation of these Terms, applicable laws, or our other policies.

5. Acceptable Use

You agree not to:

• (a) use the Site in violation of any applicable law, regulation, or third-party right;
• (b) reverse engineer, decompile, disassemble, or otherwise attempt to derive source code, structure, or ideas underlying the Site, except as expressly permitted by law;
• (c) scrape, crawl, harvest, or use automated tools to extract content or data from the Site without our prior written consent;
• (d) circumvent, disable, or interfere with security, authentication, or access-control features of the Site;
• (e) introduce malware, viruses, or other harmful code;
• (f) use the Site to transmit unsolicited commercial communications, spam, or phishing attempts;
• (g) impersonate any person or entity or misrepresent your affiliation;
• (h) copy, modify, publicly display, publish, sell, resell, or otherwise exploit any part of the Site or its content for commercial purposes without our prior written consent; or
• (i) use the Site to develop a competing product or service.

We reserve the right to investigate and take action against any violation, including suspension, termination, and legal remedies.

6. Submissions

If you send us content through a contact form, portfolio inquiry, job application, testimonial, or other non-contractual channel (“Submissions”), you grant TTGC a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, adapt, publish, display, and distribute the Submission in connection with TTGC's business, including promotional materials, unless you have a written agreement with us that says otherwise. Do not submit anything you consider confidential or that you do not wish to grant this license over.

This section does not apply to Client Content delivered under an executed MSA or Subscription Terms, which is governed by those agreements.

7. Intellectual Property of the Site

The Site and its content — including the TTGC name, logos, trademarks, service marks, text, graphics, images, videos, design, code, structure, and underlying technology — are owned by TTGC or its licensors and are protected by UAE and international intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Site or its content except the limited permission to view and use the Site as intended.

Any unauthorized use is a violation of these Terms and applicable intellectual property law.

8. DMCA and Copyright Infringement

If you believe that content available on the Site infringes your copyright, please follow the procedure in our DMCA Policy at ttgcreatives.com/legal/dmca. The DMCA Policy describes how to submit a takedown notice, our counter-notice process, and our policy on repeat infringers.

9. Privacy

Your use of the Site is also governed by our Privacy Policy at ttgcreatives.com/legal/privacy-policy, which describes what personal data we collect, how we use it, and your rights in relation to it. By using the Site you acknowledge the Privacy Policy.

10. Cookies

The Site uses cookies and similar technologies as described in our Privacy Policy. Where required, a cookie banner lets you manage your preferences.

11. Third-Party Links and Services

The Site may contain links to third-party websites, products, or services. We do not control and are not responsible for the content, policies, or practices of third-party sites or services. Accessing them is at your own risk and subject to their own terms and policies.

12. Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY LAW. TTGC DISCLAIMS ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

We do not warrant that the Site will be uninterrupted, secure, or error-free; that defects will be corrected; or that the Site is free of viruses or other harmful components. You use the Site at your own risk.

Any reliance on content on the Site is at your own risk. Portfolio examples, case studies, and estimates shown on the Site are for illustration only and are not a guarantee of the results or outcomes of paid services.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TTGC OR ITS DIRECTORS, OFFICERS, EMPLOYEES, DESIGN AGENTS, OR AFFILIATES BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF TTGC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE EXTENT ANY LIABILITY OF TTGC UNDER THESE TERMS IS NOT PROHIBITED BY LAW, THE MAXIMUM AGGREGATE LIABILITY OF TTGC IN CONNECTION WITH THE SITE SHALL BE LIMITED TO USD $100 OR THE AMOUNT YOU HAVE PAID TTGC FOR ACCESS TO THE SITE IN THE SIX (6) MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

This limitation does not apply to liability that cannot be excluded under applicable law. Liability for paid services is governed by the MSA or Subscription Terms (as applicable), not by these Terms.

14. Indemnification

You agree to indemnify, defend, and hold harmless TTGC and its directors, officers, employees, Design Agents, and affiliates from and against any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising out of or related to:

• (a) your use of the Site in violation of these Terms;
• (b) your Submissions;
• (c) your violation of any law or third-party right; or
• (d) your breach of any representation or warranty in these Terms.

15. Suspension and Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including suspected violation of these Terms. Upon termination, any rights granted to you under these Terms will immediately cease. Sections that by their nature should survive termination (including §§6, 7, 12, 13, 14, 17, 18) will survive.

16. Changes to the Site or Terms

We may modify the Site or these Terms at any time. For material changes to these Terms, we will provide at least thirty (30) days' advance notice by posting a prominent notice on the Site and, where we have your email, by email. The effective date at the top of this page reflects the current version. Prior versions are archived at ttgcreatives.com/legal/terms-of-service/archive/. Continued use of the Site after the effective date of any change constitutes acceptance.

17. Governing Law and Disputes

These Terms are governed by the laws of the United Arab Emirates, without regard to conflict-of-law principles.

Any dispute arising from or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE. At TTGC's sole election, any such dispute may alternatively be resolved by binding arbitration under the DIAC Arbitration Rules, seated in Dubai, in English.

Nothing in this section limits TTGC's right to seek urgent injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property, confidentiality, or other rights.

For clients engaged under the MSA or Subscription Terms, the dispute resolution provisions of those agreements govern the contractual relationship and prevail over this section in connection with paid services.

18. General

• Entire agreement. These Terms, together with the Privacy Policy and DMCA Policy referenced herein, constitute the entire agreement between you and TTGC concerning the Site.
• Severability. If any provision is held invalid or unenforceable, the remaining provisions remain in full effect and the invalid provision shall be replaced by a valid provision that most closely reflects the intent of the original.
• No waiver. Failure to enforce any provision is not a waiver of future enforcement.
• Assignment. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
• Language. These Terms are drafted in English. Any translation provided is for convenience only; the English version governs.
